Fatal Pedestrian Accidents in New York

Fatal pedestrian accidents occur far too often due to the negligence of drivers here in the state of New York. There are multiple factors that contribute to these incidents. Far too often, negligence plays a role in fatal pedestrian crashes across our state. Leading factors include:

Distracted drivers: Distracted drivers often take their attention from the road to use their phones or engage in other activities, making them less likely to notice pedestrians.

Speeding: Speeding reduces a driver’s reaction time, which can make it more difficult to stop in time to avoid a collision with a pedestrian.

Impairment: Impaired drivers are far less capable of making responsible decisions due to having impaired judgment. This drastically increases the risk of accidents involving pedestrians.

Failure to yield: Failure to yield to pedestrians at crosswalks and intersections is another common cause, as drivers may not respect the rules designed to protect vulnerable pedestrians nearby.

When a pedestrian dies due to a negligent driver, surviving family members in the state of New York may file a wrongful death lawsuit against the responsible driver. Damages that families can recover typically include medical and funeral expenses, loss of financial support, and emotional suffering. Depending on the circumstances of the accident, punitive damages may be awarded to punish the negligent driver for their actions. It is crucial to reach out to a wrongful death lawyer in Commack as soon as possible.
