Car Accidents in New York

It is undeniable that automobile accidents in New York take place at an alarming rate. In 2022 alone, more than 10,500 motor vehicle collisions occurred. Nearly 40,000 of these accidents resulted in injuries or fatalities for those involved.

The injuries that victims suffer from during motor vehicle accidents can be devastating. Unfortunately, they often require a significant amount of medical care. After being harmed in an accident, car crash victims have the ability to file a claim for compensation against the responsible party. In New York, you must be able to demonstrate that the defendant is responsible for the accident.

It is important to know that when filing a personal injury claim, the amount of compensation that you are able to recover is based on the pure comparative negligence rule. This law states that you are able to recover compensation for all of the damages that you have suffered in your accident that were caused by the other party involved. Even if you are found to share the majority of fault for the accident, you still have the ability to recover compensation for the damages that you have suffered as a result of another person’s negligence.

However, the amount of money that is awarded to you will be reduced to reflect the percentage of fault that you shared for the accident. This makes it critically important for you to have strong legal representation following your accident to help you maximize the money you are able to receive. A Queens car accident lawyer will be able to fight fearlessly to ensure you are able to maximize your recovery for medical costs, lost earnings, and more.
