New York follows a pure comparative negligence rule, and it can significantly shape how much money you receive. Under Section 1411 of New York’s Civil Practice Law and Rules, your compensation gets reduced by your percentage of fault for the incident, even if that percentage is higher than the other party’s share. (The one exception is for motor vehicle accidents, as CPLR § 1411(b) now states that you can only recover damages if your share of fault is less than the other party’s.)

For example, if a court decides you were 20 percent at fault for a fall because you missed a posted warning sign, and your total losses equal $100,000, you could still recover $80,000. This rule applies no matter how the incident occurred, whether it involved a distracted driver, a store that failed to post a wet floor sign, or another form of carelessness.

How Compensation Is Calculated

Calculating personal injury compensation starts with adding up your economic losses, as these numbers come directly from bills and pay records. From there, insurance companies often use one of the following two methods to estimate non-economic compensation:

  • The Multiplier Method – This approach multiplies your total economic losses by a number, often between 1.5 and 5, based on the severity of your injury.
  • The Per Diem Method – This approach assigns a daily dollar amount to your pain and suffering, then multiplies it by the number of days you experienced
